Terms of Service

1. Agreement to Terms

By accessing or using Hubrix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Hubrix provides a link-in-bio platform that allows users to create customizable pages containing links, media embeds, and other content to share with their audience.

3. User Accounts

  • You must be at least 13 years old to use this Service.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete information when creating an account.
  • One person or legal entity may not maintain more than one free account.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute malware, spam, or phishing content
  • Harass, abuse, or harm another person
  • Impersonate any person or entity
  • Distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated means to scrape or collect data from the Service
  • Resell or redistribute the Service without authorization

5. Content Ownership

5.1 Your Content

You retain ownership of content you create and upload to the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content solely for the purpose of providing the Service.

5.2 Our Content

The Service and its original content (excluding user-provided content), features, and functionality are owned by Hubrix and are protected by international copyright, trademark, and other intellectual property laws.

6. Subscription and Payments

  • Some features require a paid subscription.
  • Payments are processed by Paddle, our merchant of record.
  • Subscription fees are billed in advance on a monthly or annual basis.
  • You may cancel your subscription at any time.
  • Refunds are handled according to our refund policy and applicable law.
  • We reserve the right to change pricing with 30 days notice.

7. Username Policy

  • Usernames are available on a first-come, first-served basis.
  • We reserve the right to reclaim usernames for trademark violations or impersonation.
  • Inactive accounts may have usernames reclaimed after 12 months of inactivity.
  • Usernames that violate our acceptable use policy will be removed.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the account settings or by contacting us.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

IN NO EVENT SHALL HUBRIX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Hubrix and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service, or your violation of these Terms.

12. DMCA / Copyright Policy

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe content on our Service infringes your copyright, please contact us at legal@hubrix.me with the required information under the DMCA.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
